I apoligize if this is out of place.

I just want to take a moment and wish all who will recieve it a Merry Christmas and a happy new year!

I would also like to say thank you to all of you who take time and effort and finances out of your lives to stand up for freedom!A special thanks to you Walter for all the work you put into this forum that all the rest of us use to communicate whats in our hearts and what is happening in this fight!

We have done pretty well folks,we were supposed to have this thing around our necks by now and so far most of us do not have a NAIS to deal with!

It just goes to show what can be done when we all work together to protect our individuality.

2010 will see many challenges to overcome; many govt and corporate fascist agendas,I am confident that America, you and I, will come out on the winning side when all the smoke finally clears.

May I suggest that we all take the time to clear our heads and hearts, set the worry aside for a few days and just immerse ourselves in our familys and our friends,to consider what we have and where we are, and to take a moment to be grateful and love them all, sure times are hard, but theyll still be hard next week,so breathe a deep breath, rest your mind and body and we can all get back to kicking this crap in the teeth in a week or so.Lets not let them steal our joy! Merry Christmas;Happy Holidays to you all!....Lee

"Who says that the words “implantable device” can’t be interpreted as those in power see fit."
This National Device Registry, which has created such hysteria, is nothing more than a clearing house of safety information. It will enhance notification in case of the potential for a serious medical problem or death as a result of an implanted medical device (devices which are well defined).
It does NOT track individual humans nor does it control your CHOICE to get said device or not.
It is safety information ONLY. It also will ensure that such safety information is made available to the public so if enacted, you would be able to look it up yourself.
Which way do you want it? Do you want manufacturers to have to be upfront and honest about safety issues with these devices or do you want them to keep it to themselves until several deaths have been reported?
Furthermore, under the existing law: SEC. 519. [21 USC §360i] Records and Reports on Devices; General Rule
 (2) Any patient receiving a device subject to tracking under paragraph (1) may refuse to release, or refuse permission to release, the patient's name, address, social security number, or other identifying information for the purpose of tracking.
This language has NOT been changed in the current proposals.
So there you have it. If you don't want anyone to notify you if the pacemaker or heart valve you had implanted has been discovered to suddenly fail, have at it. It's still your right to refuse. I hope you see that tiny notice in your newspaper before your pacer stops functioning or your heart valve quits functioning.
And BTW, device tracking simply means tracking safety reports on medical devices. It does not mean tracking YOU personally.
One of the many problems with the 2 massive versions of these bills is that they took existing laws and/or regulations and stuck them in these bills. In many cases changing just an insignificant word. I believe these fools thought this would make them look "all good and all wonderful". They are so far out of touch with the real world that they had no clue people would read into it.
Remember - every device has a serial number, just as every TV, camera, computer, etc does.
Meanwhile, while people debate something that isn't even remotely planned, they are shoving through legislation that will cost us all plenty in taxes and most probably higher insurance premiums down the road without making ANY significant reform to our health care system.

Two good articles to read at newswithviews.com One today by Phil Hart has to do with the constitutionality of the healthcare bill...and I also recommend you look up attorney Jonathan Emord (left sidebar) and read his last article re: FDA . You will see parallels to NAIS...

There is a difference between not trusting the gov't and not liking the health care bill, and spreading false information. If you think that implantable devices refers to microchipping humans, then you should qualify your statement by saying that is what you believe it means. To come out and declare that it mandates microchipping is false and will make us look unreliable on our other statements.

An implantable device MAY BE as you said--- for the tracking of working/non-working heart devices BUT I am "paranoid" for a reason. Who says that the words "implantable device" can't be interpreted as those in power see fit. Did you notice how our elected offal stayed late to force the passage of the health bill? Even though they know the majority of those who elected them oppose it or want more time to discuss and research it, they completely ignored our wishes. What does that tell you? And after seeing the way things are going I would not call it paranoid. I would call it being smart and watching out that our freedoms are not legislated out from under us. After all would you be paranoid if you heard a ratlesnake hissing in your house? You know it has a purpose in nature but that purpose does not extend to inside your house where it would be dangerous to you! You would hunt it down and get rid of it to protect your family.

Does Congress have the the constitutional authority to mandate the purchase of insurance from private companies?

This is an good discussion of the issue:

Link

If NAIS is mandated the executive branch will be facing the same question regarding the constitutional authority to force the purchase of services from a private company.

Esbee wrote:
"and with obamacare health plan’s mention of mandatory microchips in humans"
There is NO requirement for humans being implanted with microchips in the health care reform bills! The Safe Medical Device Act was passed into law in 1990. ALL this is, is an update to that existing law and it refers to implanted debrillators, pacemakers, etc. It simply ensures timely notification in the case of a recall - that is IT. Would you not want to be notified if a serious problem was discovered with the pacemaker or defibrillator wires in your heart or would you rather just drop dead walking down the street? Relying totally on the manufacturer is a bit like saying you prefer to rely on Monsanto for information about seeds! Reality is these manufacturers do "outsource" some of the parts for these life saving devices. Do I wish all medical device manufacturers were above board? You bet I do but reality is they are not.
People have become so paranoid because of NAIS that they are misinterpreting this piece of the health care reform legistation.
Please, we must be careful what information we pass around lest we be painted with the "misinformation" brush again.
I am a Critical Care nurse who works with these devices. I have worked with this law since it was enacted so I know why it was created and what it's intent is very well.
